Federal legislation in the United States protects the right to an abortion. Roe v. Wade (1973) and Planned Parenthood v. Casey (1992) decisions from the Supreme Court guarantee that states are unable to outlaw abortions prior to the fetus being deemed viable. 

A number of states amended their state constitutions to include the right to an abortion in 2022: 

Proposition 1 in California

Michigan: Third Proposal

Vermont: Fifth Proposal

In 2022, some states declined to impose limits on abortion: 

Kansas: Referendum on abortion

Amendment 2 in Kentucky

Legislative Referendum No. 131 in Montana
